YouTube - Terms of Service or Terms of Bullshit?

Post by KEN »

I recently uploaded a tutorial video on youtube about how to install a mod for Mortal Kombat PC, after 25,000+ views it was taken down because it contained some "Inappropriate" content.
I appealed and it got rejected. Now I asked them to tell me what really is inappropriate in it but I doubt they will answer.
There is nothing inappropriate in it, I uploaded it here: http://videobam.com/sXSWm
see for yourself.

Then I tried adding the same video from a different channel, again but this time instant removal. No wait for views, it just got deleted while processing. Tried again with a 3rd channel (an e-mail), and same, removed while processing.

I asked youtube to tell me what is inappropriate in the video since I cant figure out really coz there is nothing wrong with it. Basically it's just a video showing how a copy paste of some files.

This also might have something to do with countries, they treat people from different country differently for their ads and maybe they just dont like some.

1. yes seen the video, didn't look wrong, but there are things i would have done differently tho.
- links in description looked a lot like spam / mass adverts (you should say like "you can grab the files needed HERE + link)" not say "download link", youtube MIGHT even have automatic detection against "download link" because lot of fake uploaded (who rip off videos) use that specific think in description to get idiots to download their spyware.
2. i would not use fullscreen, resize recorder window (i dont see this being against terms tho, just something i would not do, ive done it in past, but not anymore)
3. do not say "im not author of this" that may get their or somebody elses attention, just say nothing on video, into description you can add "Credits goes to bla bla for creating the modded files"

But yeah, i think it has lot to do with country too. for example i haven't seen many russian youtubers, probably cuz they dont like them. same with your country, lot in your country are corrupt and upload shit, so they may not even review it, they might just think "hmm .. this country again ... BAN"

Also youtube / google workers maybe corrupt, after all its about money. I assume all people who work for / in google or youtube earn a good money, but is it ever enough? i don't think they earn like 10k a month for just reviewing some videos ..etc.
my point being, if someone pays google / youtube employer to fuck someone over, they might .. but clearly this isnt the case, you're not famous enough to get that sort of attention, i don't think anyone would spent thousands just to screw your video up.

ALSO it could be, that they have country based reviewers, like if you're from US, then there is person from US who will review the video, but i doubt.

....after all, even google and youtube are ran by only humans, meaning that corruption is always probability. Even governments are compromised, you can buy yourself a passport, guns ..all sorts of stuff that should not be possible.
..or some employer is just in shit mood and fucks you over just cuz he/she feels like it.

I've never had such issues, i had strike once cuz of friend's video, he put copyright music on it and i got fucked cuz of that, but its long gone and im back in good standing, fully featured, however im having issues with monetizing videos. I uploaded 2 GTA IV crash videos, one was monetized, other wasn't, both are exact same thing (only different crashes on them).
so clearly it highly depends on who reviews the video, but remove it with strike? hmmm

2nd and 3rd try (different channels) had nothing in description, they still got removed.
It's like the one reviewing just dont want that video up there for no reason. It is the country thing I believe.

lol, there has to be something that gets their attention, its not like youtube manually checks videos, they only check if you send it to monetization or when someone reports.
copyright is automatic detection (music + exact replica upload). if you rip somebody's video and re-upload, most likely youtube will auto-detect that it has been uploaded by someone else (but only if its copyright legally).

Music belongs to luigi, and I use the same in my other videos as well so if it was the music, then other videos would be flagged too.

Well got a reply from their support and just what I was expecting, monkeys sitting behind the support system and copy pasting same thing over and over. I wrote clearly that if you really feel that there is something inappropriate in the video, TELL ME what it is so I don't repeat the same mistake.
Reply I got was obviously.. "video is inappropriate blah blah it breaks TOS and appeal at: link."

Well can't expect anything from support these days. Not just youtube, many others too. It's same with everyone, copy paste.

yeah its retarded that they just paste some shit without even looking.
i actually think that 90% of google/youtube is automated. i read lot about monetization, because they fuck me over sometimes. people say same, its random and that it uses automatic process.
for example one of the videos i released recently, i uploaded on both channels, took 2-3 days to monetize on my primary and on other still "under review"
usually videos get reviewed within hour, so no idea .. if automatic system can't determine if its allowed or not .. will they review manually? like WTF is going on.

im quite sure your question never reached the support, probably some automatic reply based on keywords.
most stuff is automated nowdays, including youtube's copyright system, its automatic.

I used Luigi's music and tracks got recognized as copyrighted music like 3 times, i found the actual song and listened to it .. not even close to what they say it was. so i sent the dispute, after 1-2 weeks claim was removed and video monetized, so obviously they DO check sometimes, but as i told you before, you have to include every little detail or they wont give a fuck.
I gave them direct links to sources, link to Luigi's site + the mp3 download, i also said that Luigi's music is not copyrighted and it is public + Luigi is a friend and he gave me permission to officially upload it on my channel. Also i included links and notes about the track that it was recognized as and explained that "this track is not even close to what it was recognized as".

However if one of them would have been a game video, i would not dispute, because they might not like the game content. One of those videos was just a visualization with Luigi's track playing and other was my PC build video, so i own all the rights (thats what i chose when disputing).

Well another retardness is that there is word limit and I couldn't have included links while appealing dispute otherwise I would just run out of text to write and they wont understand anything.
So its like it's there just for show to just make people think they have some power over it and after appealing nothing's gonna change ever.

During appeal I said music belongs to a friend luigi and has been added with his full permission and video recording is my own and I own all rights..

That's where it ran out of words.

I didn't have that problem, you just have to put only few words, but make a good point.

Yeah Youtube is a freaking joke and dominated by Copyright Nazis, probably because Scroogle owns it. I hate that site and try to minimize use whenever possible. We need more Youtube alternatives and a way to spread their word.

Now that you brought this old topic up, i'd like to mention that I've been using youtube since the beginning (well maybe 6-12 months after youtube launch i started using it), my account is like 9 years old and i have never had any copyright issues. Well i did have a strike, but it was my own fault, i disputed a copyrighted song, i don't even know why i did that.

However i do agree that youtube is too excessive with the copyright shit. my "The Crew" trainer (hack) videos got copyright notices because Ubisoft got butthurt and filed copyrights against all of them. no strike tho, it just said matched 3rd party content and video is globally blocked. Such shit does not happen in any other site as far as i know.
This is not even copyright .. i mean it is UNTHINKABLE that i record a video of myself and have like Samsung TV on background and samsung sues me and says "this is copyright, you have recorded our TV without our permission".
Same goes for game footage, a game footage is NOT copyright and it can be shown after game has been released in public.

and another note, youtube protects good content creators with lot of subs or old accounts. my friend recently got a community guideline strike for a game trainer video. i have NEVER received any community guideline strikes or notices, i guess youtube wont even allow this on old accounts or ppl with lot of subscribers. I mean think what happens if someone like Pewdy received a strike. he'd probably sue the entire youtube lol.
it's just when ppl create multiple accounts using same PC / IP and then "spam" videos all over.
Have 1 account and don't abuse it, you'll be perfectly fine.

Another thing I hate about Jewtube is if you upload something with copyrighted material to critique it you can get banned or warned. Even though a critique is covered under fair use. Cyber Nazis...

I recently got a community strike out of nowhere and had no option to dispute. i contacted my partner program about it and they have no idea why. video was clearly not spam (which was reason for removal).

I think youtube staff clearly abused the power, some faggot must have had bad day and when reviewing he/she just marked video as bad and removed.
what piece of shit.

In general I think that anyone who can't handle internet, should not be in internet. such as porn, bad words, nudity, criticism ..etc
I mean i'm down with the "keep it within limits", like don't freaking spam and spaz out like "YOU FUCKING FAGGOT FUCK FUCK SHIT ASSHOLE FUCK SHITHOLE WTF NOOB OMG ASSHOLE WTF DIE PIECE OF SHIT WHAAA" .. this is just lame spam and kiddish, but as long as it's within limits like someone saying "you're a fucking retard for beliving this", then i see no problem. can't take it? shut off your PC and never return into internet, go live under a rock and never climb out.
same goes for those who spaz out over a damn nude girl pic.

but most idiotic is the copyright shit on youtube, i mean i respect copyright and i don't copy content, but if i make a video of game, how the F is that copyright ??????!!!!!!!
I know i did not make the game, but compare it to this:
I go onto street with camera (it is LEGAL to record in public areas) and record a ferrari driving by, then i upload the video and get copyright from ferrari for recording their car??? i don't think so, that's nowhere near copyright. same with a game, i record my computer screen, where you can see gameplay at the moment. that's nowhere near copyright. they need to get their heads straight.

yeah i agree.. youtube is mostly automated nowadays.. it's just too many videos, too many uploaders.

i believe unless you are really well known and popular on youtube.. if you get banned or get a video deleted.. you are wasting your time trying to get it back.. just my 2 cents

Funny that you guys still active in this topic, but if anyone wants to know more about this, go search "SmarterEveryDay" channel and search for his video about manipulating youtube algorithm or something like that, he actually went to youtube (as he has good connections) and asked lot of stuff about it, he explains it very well how people manipulate youtube to either get more views or subs ..etc.
